The workforce of any organization is arguably the best asset it can have and plays a critical role in the success of such organizations. The organization must understand therefore certain rights employees have when they are employed. “When individuals become employees, they take on both employment rights and responsibilities.”- (Valentine et-al). Rights are a sort of power that define certain relationships between the employer and employee. Some of them are written, while some are abstract in nature. There are also statutory rights as a result of specific laws passed by various levels of government. In this case, the National Labor Relations Act as passed by congress in 1935 states that it is the policy of the United States to encourage collective bargaining by protecting workers’ full freedom of association. The NLRA protects workplace democracy by providing employees at private-sector workplaces the fundamental right to seek better working conditions and designation of representation without fear of retaliation. (National Labor Relations Board). Therefore, regardless of what might be obtainable in the company handbook, this potential conflict must be resolved amicably and within the confines of the applicable law.

Cost of living allowance (COLA) as a perk that most organizations employ to inspire and motivate their employees is optional. However, in this case, the employees have been pretty much used to it, therefore the removal must be handled in a way that ensures organizational justice. “Organizational justice is the fairness of decisions and resource allocations in an organization.” (Valentine et al). According to the same textbook source, there is a wide range of HR activities such as the case in question that can affect the perception of justice and fairness in an organization. The process of making the decision, the actual decision, and how it is communicated is critical in this case.

The procedure the company has taken to arrive at the decision such as the cost-effectiveness of discontinuing the COLA must be perceived as fair, and fairly applied to everyone. Based on the loss of revenue, is the loss of COLA benefit based on distributive justice which ensures that everyone is equally affected.? The final guide the supervisors must use is an adequate explanation to explain why the decision was made. If possible, the company accounts book explaining in detail the financial situation of the company can be made available for the employee’s perusal.

Each supervisor should effectively communicate that the company has been paying these incentives religiously along with other benefits for 15 years without the union. If the payment suspension is going to be temporal, it must also be communicated along with the company recovery plan. Finally, the supervisors should present the disadvantages of forming a union that might work against the company’s recovery plan which might eventually lead to a total collapse of the company. Managers and supervisors should continually strive to foster a perception of fairness since employees can excuse exceptional episodes of trial for such an organization. Wisdom and honesty is the key to getting everyone aligned with the vision of the company. “For by wise counsel thou shalt make thy war: And in the multitudes of counselors, there is safety.”- (Proverbs 24:6 KJV).
