Graham drives a delivery van. On Thursday, while delivering packages in a residential neighborhood, Graham hit and badly damaged a parked car owned by Arthur. At the time of the collision, Graham was driving 30 mph. The posted speed limit for the street is 25 mph, but residents customarily drive at 30 mph. On Friday, Graham left a package for Roscoe on the front step outside of his house. He placed the package just in front of the doorway, and when Roscoe walked out of his house later in the day, he tripped over the package, breaking his hip. On Saturday, while returning to his van following a delivery, Graham stopped to chat with Chris, who was sitting in his car and about to back out of his driveway. When they finished speaking, Chris began to back out of the driveway. At that moment, Graham saw a car speeding down the street towards Chris. Graham considered warning Chris of the approaching car, but since Graham was in a hurry, he decided not to go back and tell him. As Chris backed out of his driveway, he was struck by the speeding motorist and was seriously injured.
Arthur, Roscoe, and Chris have all filed lawsuits against Graham. What is Graham’s liability to one of them? Discuss in business letter form to Graham his legal liability to one of the other parties using legal principles learned this semester. Your letter should state the relevant facts, the issue, the legal rule(s) of law that apply and how the rule of law is applied to the facts of this case to answer the question raised in the issue. This does not require legal research beyond your textbook. You must include a rule of law or rules of law to support your position. You are writing a letter to the injured person trying to avoid litigation and/or limit liability.
