(ii) Answer two of the listed questions below (each answer 100 words):
1) What is meant by bearing the burden of proof in the balance of probabilities? Does mean that the plaintiff must provide evidence to courts on their own? Or does this mean the attorneys determine this?
2)What determines whether a criminal case is eligible for bail or not?
3)You mentioned that the executive branch develops and implements policies and enforces laws. Policies v. Laws. What are their differences when executed by the executive branch of the government?
4) Please elaborate, “statutes will prevail over the decisions of courts on the same matters.” I thought it was the other way around, like in the Riggs v. Palmer case, that the statutes should be interpreted accordingly in court decisions to come up with the fairest judgment.
5) In topic 2 of Issues of Fact, Issues of Law, and Matters of Interpretation of the Court Decisions. How does the court come up with the right decision when there are no witnesses for both the plaintiff and defendant? It is his words against mine situation like in sexual assault cases. How will the judge or court know who is telling the truth?
