Sentencing Guidelines – As we have learned the Sentencing Guidelines were created to do away with judicial discretion in sentencing in an effort to have a more uniform way of punishing similarly situated crimes and offenders – think about it from an intervention perspective. The Sentencing Commission noticed an issue which resulted is disproportionate outcomes at sentencing.

PSR.pdf Here I have provided you a former client, try to determine whether the Federal Department of Probation arrived at the correct number for sentencing purposes. Within the Guidelines you will need to look at Chapter 1- 5. In looking at the PSR you will notice that different aspects of the client life include social history, criminal record, facts of the incident offense etc are all used to arrive at a number which is paired with the criminal history to generate an overall range of months. It is going to take a bit of time to figure it out, but if you understand how to read a Pre-Sentencing Report and how to “plug it into the Guideline” you will leave this course with solid employable skills!
P.S. Whether or not you are able to figure it out, what I really want to know if whether this whole process via the Guidelines serves its purpose and goal of achieving even and fair punishment from court to court and state to state at the federal level? If yes, why? If you find it to be counterproductive, please explain.
