6. Freedom of Speech of Corporation: In Citizens United v. Federal Elections Commission, 558 U.S. 310, 130 S. Ct. 876( 2010), the US Supreme Court issued a landmark decision that overturned a 21 year precedent on campaign financing. Do you agree with the decision?
7. E- Commerce: Computers and Free Speech: When you do a Web search using Bing, Google, or any other search engine, the program inherent in the engine gives you a list of results. When you use a document creation program, such as Microsoft Word, it often guesses what you intend and corrects your misspellings automatically. Do computers that make such choices engage in “speech” and if so , do they enjoy First Amendment protection? Facebook has numerous computers, all programmed by humans, of course. If Facebook’s computers make decisions that allow your private information to be shared with you knowledge, should the First Amendment protect Facebook? Why or why not? Should they? 8. Medical Marijuana and the Commerce Clause; More than a dozen states in the United States have adopted laws that legalize Marijuana for medical purposes. Is Marijuana possession legal under state law? Federal Law? What is the main US Supreme Court case discussing the issue ? What is the reasoning of the court and do you agree with the court decision legally or ethically?
9. Equal Protection: A state legislature enacted a statute that requires any motorcycle operator or passenger on the state’s highways to wear a protective helmet. Jim Alderman, a licensed motorcycle operator, sued the state to block enforcement of the law. Adelman asserted that the statute violated the equal protection clause because it placed requirements on motorcyclists that were not imposed on other motorists.
Legislation aimed at ” protecting people from themselves” concerns the individual as well as the public in general . Protective helmet laws are just one example of such legislation. Should individuals be allowed to engage in unsafe activities if they choose to do so ?
