Assignment Facts:
Mr. Jitters has always been a bit of a nervous wreck. One day he was driving home, abiding by all traffic laws, when out of nowhere Ms. Zoom recklessly cut in front of his car, coming within inches of a collision. Mr. Jitters went into a full-blown panic attack. He pulled over, taking deep breaths to control his heart rate. After two hours he regained his composure and drove home. However, since that day, he has not been able to drive himself anywhere and wakes up every night with nightmares of Ms. Zoom almost colliding with him. Due to his inability to drive and lack of sleep, Mr. Jitters lost his job and now wants Ms. Zoom to be held accountable. This is the case of Jitters (plaintiff) v. Zoom (defendant).
Assignment: Draft a response defending one of the two conclusions:
Ms. Zoom is most likely civilly liable to Mr. Jitters for the intentional infliction of emotional distress.
Ms. Zoom is most likely not civilly liable to Mr. Jitters for the intentional infliction of emotional distress.
Draft a four-paragraph essay (as defined in the “Grading Criteria”). Only TWO acceptable sources are to be used (no more, no less). This is discussed in the Grading Criteria (see below). Essays that are not drafted according to the Response Template may not be graded until an oral examination confirms it’s originality. Refer to the Syllabus.
For students citing state law, both sources must come from the same jurisdiction (i.e., the same state). Federal law does not apply.
Both sources must come from either FNU’s ProQuest or LexisNexis. Download, save, and attach when submitting the final draft for grading.
