This assignment has many purposes. With respect to skill-building, students will learn strategies for legal research, practice analytical writing, and practice presenting information succinctly. With respect to content, students will gain some understanding of legal decision making and its significance, learn more about a particular US policy area of interest, and learn other cases and their significance from classmates.
We will meet in the Library soon to begin learning how to do legal research. Presentations will take place in the same order as the cases in the list below.
The Written Assignment: In this 7-9 page (double-spaced) paper, students will:
Explain the facts of the case.
Describe the path of the case: in what court the initial trial took place.
Explain the legal question raised in the appeal: is it a question of civil rights? Civil liberties? Federalism? A constitutional right or an implied right? Other?
Explain how the case made its way to the Supreme Court (this requires explaining the appellate decision);
Explain the Court’s decision.
Explain the reaction to the decision in newspaper and law review articles, and subsequent developments in the same policy area;
Evaluate the decision and its implications for US politics today, including relevance to public opinion and the 2024 presidential election.
The written assignment will be carried out in several steps. Each step will be its own assignment with its own grade: initial hypothesis/topic statement/research question; annotated bibliography of 4-5 sources; outline, paper; plus, opportunity to revise the paper. See separate assignments.
The Research: You will gather the above information through three research steps: newspaper research, law review research, and researching the Supreme Court decision itself.
Step One: As you are making your choice of which case to study, find a good newspaper article that explains the facts of your case and the Supreme Court’s decision.
Step Two: Find and read 2-3 Law Review articles about your case that will help you understand the constitutional question central to your case (we will learn how to do this during the Library session);
Step Three: Read the Court’s decision itself.
