Gabriel came to the United States with his family, across a land border, when he was two years old without documentation and undetected by border agents. After he turned 16 years old he applied for and was granted Deferred Action for Childhood Arrivals (DACA). He continues to renew his DACA as required. Congress passes a law, when Gabriel is 20 years old, rescinding DACA. Gabriel files a suit arguing that Congress violated the separation of powers by usurping the Executive Branch’s power to execute laws including deciding who to deport.
