Module 06 Discussion – Juvenile Scenario
Brady Huspek
1) The rights that Jim would be afforded are the right to remain silent, and the right to an attorney
2) Jim would not be afforded a jury trial or be able to be bailed out
3) As this is murder and not his first offense he would be waived to adult court and be charged with second-degree murder as it was not premeditated but did have intent, the maximum he would be sentenced to in the state of Minnesota is no more than 40 years.
4) Even though Jim was waived to adult court as he is still a juvenile he could not be sentenced to life without the possibility of parole or the death penalty.

1.Jim process right’s should be notice of the charges, the right to counsel, the right to confront and cross-examine adverse witnesses, and the right to remain silent.
2 Jim.(Juveniles) don’t have all of the same constitutional rights in juvenile proceedings as adults do. For example, juveniles’ adjudication hearings are heard by judges because youthful offenders don’t have the right to a trial by jury of their peers. They also don’t have the right to bail or to a public trial.
3.Jim sentence should be the maximum sentence why because he intent to kill some one . ( Any person who is found guilty of murder in the first degree who committed the offense on or after the person’s fourteenth birthday and before the person’s eighteenth birthday shall be punished by imprisonment in the state prison for life and shall be eligible for parole after the term of years fixed by the court pursuant to section 24 of chapter 279.
It makes no change for murder in the second degree or in the handling of commuted sentences.
Any person who is found guilty of murder in the second degree shall be punished by imprisonment in the state prison for life and shall be eligible for parole after the term of years fixed by the court pursuant to section 24 of chapter 279.)
4.He can not be sentence life(The Supreme Court ruled that juveniles cannot be sentenced to death, writing that the death penalty is a disproportionate punishment for the young; immaturity diminishes their culpability, as does their susceptibility to outside pressures and influences.)
