Your client, Pedro, decided to study the martial arts to get in shape. He joined the Karate Center, where the instructor, Master Chen, has been teaching karate for twenty years. After training for two months, Pedro was promoted to the rank of yellow belt.
Master Chen offered separate sparring classes for his students. These sparring classes were separate from his regular classes. Master Chen did not allow sparring in his regular classes.
Pedro decided to participate in one of the beginning sparring classes. He had watched the classes a couple of times, and he thought it would be fun to try sparring. He knew that in the sparring classes the students actually kicked and punched each other, though Master Chen made it clear that he expected all students to exercise control at all times. Students in the sparring classes also wore protective equipment, though sometimes a student was injured despite these precautions.
In his first sparring class, Pedro was paired with another student, Beth, for the first round of sparring. Beth had a green belt, just one rank above Pedro, but she had sparred in several tournaments and had won her division each time. They sparred for approximately thirty seconds when Pedro stepped toward Beth just as Beth punched Pedro in the chest, just above the heart. Pedro went into cardiac arrest as a result. One of the students immediately called 911. The paramedics arrived, revived Pedro, and took him to the hospital. Because of the length of time before he was revived, Pedro suffered brain damage.
Pedro wants to sue Beth for battery. According to the law, a person commits battery when they 1) act with the intention to cause a harmful or offensive contact, and 2) harmful or offensive contact results.
Based on these facts and this law and nothing else (except a legal dictionary), answer this question: Did Beth commit a battery on Pedro? Note that this question/ issue involves the tort of battery, not the crime of battery. Do not consider any other questions or issues. In legal writing, the ability to follow instructions is critical.
