Hello! This is an essay for my Cyberlaw module. The essay question is: ‘Cyberspace is not a space beyond the rule of law.’ Critically evaluate why States have found the regulation of Cyberspace challenging and how they may overcome these obstacles. GUIDANCE: – The essay question can be answered in different ways. It is entirely up to you how you critically argue “why states have found the regulation of cyberspace challenging”. It also possible that you may disagree that states have found it challenging to regulate cyberspace (which is fine), but whatever you argue that discussion/argument needs to be supported by literature and (ideally) with one/two examples of issues (e.g. online harm, hate speech, content regulation, freedom of expression, privacy. Think in this way: if disinformation is a problem, restriction on freedom of speech and expression is equally problematic, and in such a situation, developing a regulatory framework would be challenging). – The structure of the analysis is critical: although there is not a great deal of room for scene-setting or description, the introduction should contain a signposting paragraph. – The introduction should clearly state the position the essay is taking. It should introduce the overall argument, plus how each section will contribute to the argument. Be specific. Introduce the structure of the essay.
– Throughout the essay, focus on the question and the development of an academic argument rather than explaining all that could be relevant.
– Acknowledge different perspectives and academic positions, but focus on acknowledging them whilst detailing why you are taking the position you are taking. – Please only use academic articles (. journal articles, law reviews) or books as sources (no Wikipedia or blogs).
– Please use OSCOLA guidelines for referencing (footnotes and bibliography). I’ve uploaded two PDFs to help with this.

– I’ve also uploaded 3 handouts on Privacy and Freedom of Expression, Hate Speech and Harassment. Each have valuable information and a list of various sources (articles/books) relating to that section. – As it is a law essay, cases and legislation should be used throughout the essay to support the argument if relevant (no requirement as to how many).
