compare and contrast the ethical issues in at least four of the key concepts of rights

July 29, 2021
Christopher R. Teeple

In a 2-3 page paper, using 2 of this week’s case studies, compare and contrast the ethical issues in at least four of the key concepts of rights:
negative rights
positive rights
natural rights
legal positivism
legal naturalism
positive privileges
negative privileges
inalienable rights
Communitarianism
side constraints
civil rights
human rights
individual rights
universal rights
legal rights
entitlements
For example, in this video case study about a steeplejack. (https://www.youtube.com/watch?v=3R3-YwDZrzg) The steeplejack climbs the chimney without any safety equipment. Consider whether he has any rights to a harness or hard hat, and if we should force him to wear one if he doesn’t want to. In other words, does he have a basic positive right to claim safety gear, and is it one that he could relinquish by choice?
Choose TWO of the following case studies from ch. 6 of Ethics and Business: Le Clemançeau (125-126), the Niger Delta (132-136), or Human Guinea Pigs (145-147). (I will provide the PDF of the book.)
Address the following in your essay:
What distinguishes a human right from a privilege, and who is responsible for granting and enforcing those rights and privileges?
Can individuals surrender their rights even if doing so is apparently not in their best interest?
Do the following in your essay:
Justify your stance with careful reasoning.
Provide relevant details from your case studies in your analysis and explain why you think what you do.
Clearly connect your stance to at least four of the key concepts of rights. Note that the key concepts do not have to be used to support your argument but can function as a counterpoint, that is, as part of your critical thinking about this issue. They might arise a concern worth considering, or perform some other function in your essay.
Note that you may use additional outside resources about your chosen case studies in your essay, but you are not required to do so. If you do use outside resources, however, please provide a citation for them.
