Name the defense and outline/explain the requirements of the defense. DO NOT assume that your client knows what you know or what you are talking about. They don’t. If they did, why would they need you? 🙂
List of what elements appear to be missing and where the elements that are met/ included are found.
Any other suggestions you may have regarding complying with the Employee misconduct defense

Absolute rules!:

No pronouns may be used. ‘I’, ‘You’, ‘They’, etc. have no place in professional writing.
For example: “I found that……….” is unprofessional.
“The review shows that…………” is more professional and carries more weight.
“Acme Safety Services review found that….” is also an acceptable format. It takes practice to not use pronouns and even more to talk about yourself in the ‘third person’. Start now!
Formatting is a requirement. Your document must be formatted to look and feel professional.
Use headers, text sizing, bold scriipt, italic scriipt, bullet points, paragraphs, etc. to accent important information.
If you think that a client is going to trudge through a non-stop narrative to glean important information, you are incorrect.
Make it easy for your client to review the information at a glance to understand the value of the work.
Be careful to not overdo it either. A ‘too busy’ formatting can detract from your work as well.
