MITIGATION PACKET GUIDELINES
In DWI cases, PTI is automatically offered by misdemeanor chiefs if it is a DWI 1st, there is no prior criminal history, no accident, and under .15 BAC.
If your DWI case is outside of these automatic admission requirements, PTI is generally denied by misdemeanor chiefs but you may appeal to the division chief. A proper appeal to the division chief requires a mitigation packet. For non-DWI cases, mitigation packets may also be requested.
Mitigation packets should include the following documentation:
❖ Letter from client: admitting responsibility, addressing how the case has impacted their life, including lessons learned, and stating why he or she should receive PTI.
❖ Admit to guilt
❖ Speak about your upbringing/childhood (explain structure of household,
explain any hardships, morals, values etc)
❖ Acknowledge why this behavior is out of character for you
❖ Speak about your character
❖ Explain how a DWI would effect you if you were not given the opportunity
to participate in this program and get it off your record in the future (Career,
life, immigration etc)
❖ Why you believe you should be given the opportunity to participate in this
program instead of probation which is a conviction on your record for the rest of your life (stay away from its your first time being arrested or in trouble, they know this, that is a requirement of the program).
❖ How you know you will be successful in completing this program
