Based on the readings listed above and the two documents posted in modules for this week,
answer the following questions in essay form.
The final case for this week is Young v. United Parcel Service, Inc. This case was the most
recent in the book (2015). What do you believe were the most important points from this case?
Did you find anything surprising or interesting?
Based on what you read in the Epilogue of the book Because of Sex are you hopeful about sex
discrimination in the workplace being reduced or did you see any reason to be concerned?
Justify your answer with specific points from the Epilogue chapter.
In the Epilogue, the author discusses Title VII cases involving appearance/grooming standards
for companies. Read the supplement in modules on the Atlantic City Borgata case that the
author discussed. Do you agree with the court’s decision in this case? Explain your reasoning.
Although the author focused primarily on Title VII cases involving women as plaintiffs, men can
also sue under Title VII if they believe they are discriminated against, which we covered
previously. For example, in the 1970s men had to file a lawsuit in order to become flight
attendants (the airline industry only wanted young, white, single, attractive women as
“stewardesses”). Gillian Thomas also mentions a case with a male plaintiff in the Epilogue. Go
to modules to review a more recent case with a male plaintiff (fitness tests debate). In this case,
a man who did not pass the FBI fitness test sued claiming sex discrimination because the fitness
test for women is not as difficult. Based on what you read, do you agree with Bauer that he was
discriminated against based on his sex? If you were a judge in this case, what would you decide?
Explain your answer based on things you learned in the course.
