The outline involves briefly summarizing the main arguments on either side of the prompt and stating your position. This should occur at the beginning of the paper.
The evaluation of competing constitutional arguments involves discussing the strengths and the weaknesses on either side of the prompt and explaining how you have come to your position. The key, here, is to pay be fair and thorough with both sides, especially the side that you disagree with.
The citing of relevant readings and lecture material is an essential component of this paper. You must provide at least four direct quotes to readings and lecture material throughout the paper. You cannot use outside sources without my permission. The method of citation is not particularly important, but if you want to be a perfectionist, copy the citation method I use each week in the syllabus.
The usage of correct formatting and legal terminology involves getting the small details right: correctly deploying terms like “opinion of the Court,” “dissent,” and “concurrence,” and submitting a paper that is written in Times New Roman, double-spaced, size 12, and no more than three pages long.
Clear writing involves following some of George Orwell’s rules: Never use a long word where a short one will do; If it is possible to cut a word out, always cut it out; Never use a foreign phrase, a scientific word, or a jargon word if you can think of an everyday English equivalent.
