This assignment comes with 2 parts. The first is a answer to discussion question

April 17, 2024

This assignment comes with 2 parts. The first is a answer to discussion questions in a main post (300 words), and 2nd is a response to 2 peers’ postings (75 words each ). I’ve attached instructions as well.
Main post:
It has been reported that because liability is a major factor in healthcare delivery and because healthcare delivery systems and practitioners seek to minimize liability whenever possible, risk management has become a necessary practice component (Judson & Harrison, 2020). Risk management is one approach to reduce the likelihood of a malpractice lawsuit.
Discuss any ethical and legal experience that you or anyone you know has faced with a healthcare provider or any business. Describe what happened and what steps were taken to resolve the issue.
1st PEER POST:
TH
Ethical and legal issues can arise in any interaction with a healthcare provider or business. One such experience occurred when a friend of mine was prescribed medication by their doctor, only to later discover that the dosage was incorrect. This mistake could have had serious consequences for my friend’s health.
Upon realizing the error, my friend immediately contacted the healthcare provider to address the issue. The doctor apologized for the mistake and promptly adjusted the prescription to the correct dosage.
This experience highlights the importance of advocating for oneself and holding healthcare providers accountable for their actions. By taking proactive steps to address ethical and legal issues, individuals can protect their rights and ensure quality care from healthcare providers and businesses alike.
2ND PEER POST:
JM
I used to distribute medication for an upscale retirement home in Nashville, Tn. If I were to have ever given a patient the wrong medication during a routine procedure, there could have been serious consequences. Firstly, it’s crucial for the patient to communicate immediately about the mistake. They should express their concerns and discuss the potential risks or side effects associated with the wrong medication. To help resolve the issue, the patient should document all relevant information. This includes details of when I did the procedure, the medication I administered, and any adverse effects she or he experienced as a result. Keeping a record will provide evidence and support their case if further action needs to be taken. Then I would have to report the incident to the appropriate governing body or regulatory agency. This ensures that the incident is properly investigated, and necessary actions are taken to prevent similar mistakes in the future. The governing body will evaluate the situation and may take disciplinary actions against me if negligence is found. If the patient believes they have suffered harm or their concerns are not adequately addressed, seeking legal advice is an option. Consulting with a lawyer who specializes in medical malpractice can help them understand their rights and explore potential legal avenues for resolution. The lawyer can guide them through the process, evaluate the case, and pursue compensation if appropriate. Sometimes when a lawsuit is brought, the trial court or a higher court must first decide if the plaintiff (the patient) has a legal reason to sue, or if the defendant (me) is liable. Karen Judson (2020). Resolving such an issue requires a combination of open communication, proper documentation, reporting to the relevant authorities, and seeking legal advice if necessary. It’s important to prioritize patient safety, hold healthcare providers accountable, and work towards preventing similar incidents in the future.
