We have been asked by the UK Junior Public Lawyers’ Association to provide a paper for a
series of debates it is holding on contemporary public law issues. I would be very grateful if
you could assist with this.
The plan is for our contribution to take the form of a response to, and analysis of the following
proposition:
For the UK constitution to function properly it is essential that all three bodies of state
be allowed to carry out their roles fully. Case law shows that all too often the courts
have failed to carry out theirs because of their own inherent deference to the executive
and the legislature.
As I have limited time at the moment, with a number of final hearings coming up, please could
you provide me with a draft for this? This should be in the form of a paper, confined to a
maximum of 2500 words. I’ll expect to see a properly developed analysis and argument which
adopts and defends a clear position on the proposition, whatever your conclusions may be.
I’m looking forward to seeing what your individual perspective is on this matter. Don’t forget to
ensure that you weigh up any competing viewpoints in developing your argument.
It is important too that you substantiate the points you make by attributing any ideas and
quotes you refer to. When providing case citations or sources for other references, the best
way to do this is through use of footnotes. These can be kept concise by providing basic case
citations and references to quotes, speeches, articles or texts – there is no need to provide
extensive detail or web references /URLs. As long as footnotes contain basic reference
information and do not include substantive commentary, they will not be included in the word
count.
