(A)1. Discuss the U.S. Supreme Court’s decisions in Plessy v. Ferguson, Brown v. Board of Education(I) and San Antonio v. Rodriguez. Explain how these decisions reflect changing interpretations of the Equal Protection Clause. 2. Justice Murphy’s dissent in Korematsu v. U.S. included the following statement:“….to infer that examples of individual disloyalty prove group disloyalty and justify discriminatory action against the entire group is to deny that under our system of law individual guilt is the sole basis for deprivation of rights.”
(a) Discuss the meaning of the above statement in the context of the Korematsu decision
(b) Define racial profiling and discuss how this statement is applicable to the problems of the pretext stop and racial profiling in general
