For the purpose of this discussion, assume you work as the Chief Compliance Officer for a company that has an online Website and an app to arrange dog walkers on 24-hour notice (DW24). DW24, which started up three years ago, currently operates in the 10 largest cities in the United States.
For the last several years, a national accounting and consulting firm has sponsored a conference for businesses entitled “Business Tips for ‘Gig Economy’ Companies.” DW24’s Chief Executive Officer has asked the company’s head of sales & marketing and head of human resources to attend the conference. In the past, conference attendees have included representatives of other large or multicity dog-walking companies, as well as representatives from online-based companies such as short-term housing rentals, driving services and delivery services.
With respect to informal conversations during the mingling events at the conference (such as at a happy hour, golf outing or bowling event), what topics would you advise your colleagues to steer clear of talking about with competitors due to antitrust concerns? Is there any other antitrust-related advice you’d give them before they attend the conference?
